1. Service Description
Wrongfully Reviewed offers brand credibility solutions, focusing on enhancing and protecting your brand’s online reputation. Our services include review management, content moderation, and brand-building strategies.
2. Guarantee and Refund Policy
We offer a 100% Satisfaction Guarantee. If we are unable to remove targeted review(s) within the specified time-frame (14 business days), you are eligible for a refund on any review not removed. This guarantee is subject to our full terms and conditions.
3. Ethical Standards
We commit to operating within legal and ethical boundaries. Our services do not involve harassment, hacking, misrepresentation, or any other unethical tactics. We adhere to all relevant laws, defamation statutes, intellectual property rights, and platform-specific regulations.
4. Service Process
Our services typically do not require access to your business accounts. We handle all aspects of the process, from identifying policy violations to communicating with platforms. However, we may occasionally require your cooperation or information to effectively represent your interests.
5. Success Rates and Time-frames
While we strive for a 95%+ success rate in review removal, typically within a week, results may vary. We ask for 12 business days to ensure the process is completed thoroughly.
6. Limitation of Liability
Wrongfully Reviewed is not responsible for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use our services.
6.1 Use of Service
By using Wrongfully Reviewed’s services, you agree that Wrongfully Reviewed, its directors, employees, partners, and agents will not be liable to you or any third party for any direct, indirect, incidental, special, consequential, or exemplary damages. This includes, but is not limited to:
a) Damages for loss of profits, goodwill, use, data, or other intangible losses
b) Damages resulting from inability to use our services
c) Damages arising from any changes to or discontinuation of our services
d) Damages related to any communications or transactions between Wrongfully Reviewed and you or any third parties
This limitation applies regardless of whether such damages are based on warranty, contract, tort, negligence, strict liability, or any other legal theory, and whether or not Wrongfully Reviewed has been advised of the possibility of such damages.
6.2 Third-Party Actions
Wrongfully Reviewed is not liable for the actions, content, information, or data of third parties. We do not guarantee the removal of all targeted content or reviews, nor can we control the actions of the platforms where such content is hosted.
6.3 Service Results
While we strive for a high success rate, Wrongfully Reviewed does not guarantee specific outcomes. The results of our services may vary based on numerous factors beyond our control, including but not limited to platform policies, the nature of the content in question, and the cooperation of third parties.
6.4 Legal Compliance
You agree that Wrongfully Reviewed is not responsible for any consequences resulting from your use of our services in a manner that may violate any laws, regulations, or third-party rights.
6.5 Maximum Liability
In jurisdictions where the exclusion or limitation of liability for consequential or incidental damages is not allowed, Wrongfully Reviewed’s liability is limited to the greatest extent permitted by law. In no event shall our total liability to you for all damages exceed the amount paid by you to Wrongfully Reviewed for our services over the past six months.
6.6 Indemnification
You agree to defend, indemnify, and hold harmless Wrongfully Reviewed and its employees, contractors, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from: (i) your use of and access to our services; (ii) your violation of any term of these Terms of Service; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your use of our services has caused damage to a third party.
6.7 Force Majeure
Wrongfully Reviewed shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
7. Modifications to Service
We reserve the right to modify or discontinue our service, temporarily or permanently, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the service.
8. User Responsibilities
You agree to provide accurate, current, and complete information as required for our services. You are responsible for maintaining the confidentiality of your account information.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Los Angeles, without regard to its conflict of law provisions.
10. Changes to Terms
We reserve the right to update these Terms at any time. We will notify users of any significant changes. Your continued use of our service after such modifications will constitute your acknowledgment of the modified Terms.
